EVP and Murder Case
Here is the scenario:
You are just learning how to conduct EVP on your own since nobody is available to teach you. This is done at your home. You get bored and start asking silly but harmless question. Like, "How did you die?"
The chilling effect. You get a lot of grade A or Class A (whatever you call it.. the very loud and clear one). Remember, think as a newbie like me. You're very first time. Any of you are professional, seasonal invesitgators put that aside. Think back when YOU were learning. Now imagine you got all these Class A EVP'S that is beyond believable.
Q: Is anyone here that will like to communicate with me?
A: I WANT MY MOM!
(Now remember you haven't reviewed it yet)
Q: What is your name?
A: I'M ROY! TALK TO ME (or Walk with me)
Q: How did you die?
A: **Name** and **Name** Killed me!
Of course in between each question you get loads of HELP ME... HELP ME... etc.
Then you listen to your recording thinking how silly this is. But what you hear just blew you away. The hair on your arm stands up, the dizziness occurs and the feel of throwing up is happening. You get fear and sickness at the sametime. You fall of your chair and finally came around to sitting up. You sit on the floor still with your mouth open with shocked and the recorder still in your hand. You get up, put away the recorder so you can get a real paranormal investigator to review it.
That evening you go to work. People wonder what's wrong with you because your attention span is short, you are not usual. People will see that there is something wrong because of your behavior. Here's the kicker:
You come home that morning after pulling an over night shift. You want to listen to it again. So you did, you listen to it over and over again and picking up more eerie EVP's. Some you can't understand it. You put it away, snap out of it because now you can get a paranormal investigator involve. You get online and see the headline news. To add more into your shock, you read the news of a man found burning and dismembered in Bradenton, Florida (less then 15 minutes where you live). What shocking is the body discovered on fire by firemen that was called to the scene happens to be the sametime you conducted your EVP. The gender of the victim is a male, the name is ROY. A suspect's name is mentioned in the news that happen to be one of the names that you got from the EVP of who killed him.
Now tell me in your own words. What do you do next?

It is obviously your responsibility to get this information to the authorities somehow. You could always annonymously send them the tape with a written explanation if you don't want to have to deal with them directly. If you know of a respected psychic in your area that law enforcement uses, you could always go through that person as well. If you feel you have information that is genuine and will help someone, you need to share it. You would want someone to do the same for someone you love.

I agree with RomanyGirl that you should contact the authorities and let them hear the tape. Maybe something will come of it, maybe not, but at least you did your part and tried.

Thank you both for responding but this is just a scenario. Nothing like that happen. I'm just asking more like... What If.
What would you do, how will you handle it, if it can help solve a case but will it stand up in court?
By the way, the murder really did take place few days ago. I was pondering if any investigators ever knew of someone or may have happened to them.

In readings your scenario, as a researcher and investigator of the paranormal it would be very rare and even questionable to get an E.V.P. like that. The reason for this is spirits have to manipulate energy and it takes a lot for them to manifest even a voice, If you listen to the E.V.P. I have on the group page you can hear the strain for it to say one word like tree. Not saying that it would be unlikely just very rare. As far as holding up in court that probably would not hold as evidence. The responses in that scenario would be more of a psychic communicating with a spirit rather then a spirit asking for help on its own.

I thought so too in a sense. I was wondering how an EVP can be legal in the court of law when the law sometimes uses Psychics to help solve a case. But never say never. I said that awhile back before believing in ghost. I never saw UFO's but now I take the terms "never say never" when questioning it's existence. I have heard a lot of EVP's and you're right, it takes a lot of energy just to even say one word. But is it possible a death like that can actually cry out just after his life was taken so severe that even names was mentioned.

I've collected a few EVP's as well and I have to agree with Dragon's Cry...something that clear, strong, and direct would certainly be a rarity. I can't speak toward the laws in your area, but I'd be shocked if it would stand up as evidence in court. In fact, it would likely cast suspicion on you, they would likely cast you as someone who 'set up' a scripted tape in order to incriminate someone (though it may not at all be true).
What to do? Alert the authorities, be prepared for the odd looks and the dismissive "yes, thank you for your help." It's your part to put it out there. It's their part to choose to run with it...or not.

I disagree with RomanyGirl and Lila. First, your chances of getting that many really good, Class A EVP's is almost infinitessimal. However, from an amateur, first-timer standpoint, I'd still get someone credible in to review the evidence. If you even THINK you're gonna go to the authorities on it and with it, you want someone to stand beside you saying they've reviewed the evidence, they have done their own investigation in your home and would like to do one on the site to further their case, and that the evidence hasn't been faked or tampered with. You know no one will believe you, you're inexperienced and you know they'll laugh at you. You have to remember this is at best a laughable field, and very little is taken seriously, all you have is a recording, so you can't just up and say, "Here's the evidence to put so-and-so behind bars! I just solved your case for you." So, you call in that investigator, pronto. You try to find a TAPS family member, for best credibility, and then he/his group will help you out to complete the remainder of whatever will happen from here on out...
That is my supposition of what if.

I think that magick-users and para-normal investigators are going to have to start studying and practicing law if they want to start seeing changes. A couple of things to ponder:
1) that are a lot of fundamentalists who have gone the legal route and are doing their best to put a stop to "magickal religions" as it is (oh, Kitka, my feline familiar is saying hello ....)
2) some cities police departments have a contact witch or pagan that they talk with if "freaky, ritualistic" crimes occur
3) the concept of EVP is so tenuous that until you have legal definitions and precedents it could only be used as a guide to help track things down, not in court.
4) I've noticed on GH that they often say "doesn't that sound like ..." and the client re-listens and agrees, but what happens if the same "word" is ambiguous enough that different people hear different words?
Say that we manage to get specified court definitions and permissions to use in court, then how do we prove it wasn't doctored up or what happens if 2 different EVP sessions contradict each other? Because our culture is so "religious-materialistic" it may be best that spiritual information is kept under the table. At least in america, we don't have a universal code of ethics/guidelines (not "set-in-stone" rules) that we could turn to when we have problems if the abuse of spiritual information and sources arises. I would like to see our culture come back into balance someday, which would include these aspects, but i fear it will not be today. Possibly after 2012, hopefully after 2012.
We just need to refine the techniques and have practitioners get into law so as to slowly shift the system. DolmaDraka
